Bar Code Industry Leaders Sue Lemelson Partnership

1999-7-22 NEW YORK, N.Y.

Seven leaders of the Automatic Identification and Data Capture industry announced today that they have jointly filed a suit in federal court against the Lemelson Medical, Educational, & Research Foundation, Limited Partnership seeking a declaration that certain patents asserted by the Lemelson Partnership against end users of bar code equipment are invalid, unenforceable and not infringed. The seven Auto ID companies are Accu-Sort Systems, Inc., Intermec Technologies Corporation, a wholly-owned subsidiary of UNOVA, Inc. (NYSE: UNA), Metrologic Instruments, Inc. (NASDAQ: MTLG), PSC Inc. (NASDAQ: PSCX), Symbol Technologies, Inc. (NYSE: SBL), Teklogix Corporation, a wholly-owned U.S. subsidiary of Teklogix International Inc. (TSE: TKX.TO), and Zebra Technologies Corporation (NASDAQ: ZBRA).

Although no claim is now or has ever been asserted by the Lemelson Partnership directly against any of the Auto ID companies, the Lemelson Partnership has contacted many of the Auto ID companies' customers demanding a one-time license fee for certain so-called "bar code" patents transferred to the Lemelson Partnership by the late Jerome H. Lemelson. The Auto ID companies have received numerous requests from their customers asking that they undertake the defense of these claims using their knowledge of the technology at issue.

Leonard H. Goldner, Senior Vice President and General Counsel of Symbol Technologies, Inc., Chairman of the steering committee formed by the seven companies, stated that: "We are extremely pleased that most of the leaders of our industry have been able to come together in a concerted effort to protect our customers against what we believe to be baseless claims. Lemelson and his agents have been able to collect substantial sums from users of bar code technology because the users have not been in a position to economically litigate against the Lemelson claims. The united front being demonstrated by the leaders of our industry will send a strong message to our current and future customers that we will not stand idly by while our industry and its customers are unduly taxed by these unwarranted claims. Neither Lemelson nor the Partnership has done anything to advance the development of bar code technology and they do not deserve to benefit from our industry's success. To the contrary, they are simply trying to take advantage of the innovations developed by the industry over the last three decades."

The complaint was filed in the United States District Court for the District of Nevada on July 21, 1999. Although there are several other pending actions involving the Lemelson Partnership and other industry groups relating to other technologies, such as machine vision systems and semiconductor manufacturing, this is believed to be the only proceeding focusing solely on the bar code-related claims being asserted by the Lemelson Partnership.
