Symbol Technologies Announces Settlement of Wireless Patent Litigation with Terabeam, Parent Company of Proxim Wireless Corporation

Symbol Technologies, Inc. (NYSE:SBL), The Enterprise Mobility Company, today announced that it has entered into a licensing agreement with Terabeam, Inc., the parent company of Proxim Wireless Corporation, relating to wireless technology. This agreement settles certain litigation between the two companies.

According to the agreement, Terabeam will pay Symbol $4.3 million to license certain Symbol patents that are related to the wireless communications standard 802.11, also known as Wi-Fi, as well as transfer certain patents to Symbol and provide Symbol a license for certain Terabeam wireless patents. The licensing agreement continues for the life of the patents. Under the terms of the agreement, Terabeam will pay the $4.3 million in a series of payments to Symbol through the second quarter of 2009.

In 1989, Symbol created the first commercially available wireless local area network (WLAN). In 1993, Symbol's joint technical proposal was accepted by the Institute of Electrical and Electronics Engineers (IEEE) as the base of the 802.11 standard. Symbol holds patents on its contributions to the specification, and has licensed these patents on reasonable and non-discriminatory terms. The agreement with Terabeam is based on terms equivalent to those given companies that have already taken a license from Symbol. Two of Symbol's patents in this area have been valued by a jury and other licensees at six percent of the price of Wi-Fi products. A third is valued at three percent.
